GENERAL CONDITIONS OF SALE
These General Terms and Conditions of Sale (GTCS) govern the contractual relationships between the company Balia and any individual or legal entity making a purchase through the website www.balia.store (hereinafter referred to as "the Client"). By placing an order, the Client unconditionally accepts these GTCS.

Products: Balia offers customizable and non-customizable wooden watches. Customized products are neither exchangeable nor refundable as they are specifically designed according to the Client's instructions. Each watch is unique and environmentally friendly.

Prices and Payment Methods: Prices are indicated in euros (€) and US dollars (USD) and include all taxes (TTC). Delivery charges are included for orders shipped to covered destinations. The Client can pay for their purchases using the following payment methods:

Payment is secure, and data is processed with the highest level of encryption. The order is considered validated once payment has been made. The creation of customized watches begins only after full payment is received.

Delivery: Products are delivered in France via Chronopost or DPD, and in the United States via FedEx or UPS. The tracking information will be communicated to the Client after the package is dispatched. Delivery times are 4 working days from dispatch, following a processing time of 7 days for customized watches.
During peak demand periods, such as Christmas holidays or sales, processing times may be extended by several days. No customs fees apply for deliveries to France and the United States. We are not responsible for any delivery delays.

Right of Withdrawal and Returns:

Non-Customized Watches: The Client has 14 days from receipt to exercise their right of withdrawal and return non-customized products. Return shipping costs are the responsibility of the Client. The returned product must be in perfect condition, in its original packaging, and accompanied by photo evidence.

Customized Watches: No returns, exchanges, or refunds are accepted for customized watches, in accordance with applicable law regarding tailor-made products.

Refunds: After receipt and verification of the returned product, the refund will be processed within 14 days.

Legal Warranty: Watches come with a legal warranty of 2 years covering manufacturing defects. This warranty does not cover:

Damages caused by improper use, accidents, or normal wear and tear.

Unauthorized repairs or modifications made to the watches.
In the event of an issue, the Client can request repair, replacement, or compensation as provided by the warranty. Warranty returns must be reported within 48 hours of discovering the defect.

Limitation of Liability: Balia cannot be held liable for indirect damages such as loss of profits, loss of opportunity, or any other financial loss resulting from the use or inability to use the product.
In the event of force majeure (see next point), Balia cannot be held responsible for delays or inability to fulfill the order.

Force Majeure: Balia cannot be held liable for delays or failures to meet its obligations in the event of force majeure. Cases of force majeure include, but are not limited to:

Natural disasters (floods, earthquakes, etc.)

Wars, riots, or civil conflicts

General strikes

Pandemics or major health crises

Government actions, legal or regulatory restrictions
These events suspend Balia's obligations for their duration.

Return Procedures: All returns are at the Client's expense. Products must be returned in their original packaging, unused, and accompanied by proof of purchase. Returns without prior agreement from our customer service will not be accepted.

Compliance with Laws: Balia is committed to complying with all applicable laws, including European regulations on the protection of personal data (GDPR). The Client agrees that their personal data will be processed in accordance with our Privacy Policy available on the website.

Mediation in Case of Dispute: In the event of a dispute, the Client may seek mediation before initiating legal action. Mediation may be conducted through a consumer mediator in accordance with the laws in force in France.
